Kmall24 offers various levels of engagement and interaction through which individuals can access our Services.
· ”Users” refers to all users of Kmall24, including without limitation (i) Members, (ii) Non-Members, and (iii) Newsletter Subscribers (as defined below).
· “Member” refers to a User who has registered as a member by providing personal information to Kmall24. 
· “Non-Member” refers to a User who uses the Services provided by Kmall24 without registering as a Member, including without limitation, browsers, vendors, merchants, and/or contributors of Content.
· “Newsletter Subscriber” refers to a User who opt to receive our newsletter by providing their email addresses and consent to receive periodic communications. Our newsletters may include updates and personalized content relevant to the Services. Newsletter Subscribers have the freedom to opt-out of these communications at any time.


MEMBERSHIP APPLICATION/SUSPENSION
An applicant shall apply for the membership in his/her/its real name. If anyone applies for the membership in a name other than his/her/its real name or by misappropriating another’s information, such applicant may be restricted from using the Services or penalized pursuant to applicable laws and regulations.

We may restrict or suspend membership without prior notification in the following circumstances:
1. ID or password theft
2. Application for membership made with falsified information in violation of this Terms of Use
3. Intentional spreading of a computer virus
4. Activities on Kmall24 that harm public order, violate this Terms of Use, and/or violate relevant laws
5. Distribution of unconfirmed or untruthful information that damages the reputation and credibility of Kmall24 or obstructs its business
6. Membership registrations that do not comply with this Terms of Use.

Our Services include provision of information about Korean culture, products, and other contents related to Korea (“Content”). This Content is for general informational purposes only. GOVERNING LAW AND DISPUTE RESOLUTION

In the event of any dispute, controversy, or claim arising out of or relating to these Terms of Use (the “Dispute”), the parties involved shall consult and negotiate with each other and, recognizing their mutual interests, first attempt to reach a solution satisfactory to the parties for at least 30 days.

If the Dispute cannot be resolved through negotiation within such 30-day period, then any party may initiate mediation by providing written notice to the other party(-ies) and the Korean Commercial Arbitration Board (“KCAB”), requesting mediation under the Mediation Rules of the KCAB.

If the Dispute cannot be resolved through mediation within 60 days after service of a written request for mediation, then the Dispute shall be referred to and finally resolved by arbitration administered by the KCAB under its International Arbitration Rules. The place of arbitration shall be Seoul, Korea. The seat of arbitration shall be Korea. The number of arbitrators shall be one (1). The award rendered by the arbitrator shall be final and binding upon the parties.


ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. These Terms of Use and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Use).
